Terms of use

Aircon & HVAC Marketplaceis one of the NearMe network's Australian marketplaces, built around second-hand and surplus air conditioning and HVAC equipment - split systems, ducted units, compressors, controllers, parts, and the trades who install and service them. Using the site, or creating an account on it, means you accept the terms below.

We run the venue, not the trade

Every listing is created by its seller, and any deal happens directly between that seller and a buyer. We do not own or inspect the equipment listed, hold sale proceeds, carry out installation work, or sign off on electrical or refrigerant compliance. Before money changes hands, check the equipment, the seller and the proposed work yourself; our safety guide covers the practical steps.

Accounts and seller identity

Listing an item or messaging a seller requires an account. Keep your login details to yourself and enter accurate information when you set one up. If you register as a business and display a trading name, you must be entitled to use the ABN you supply. Our account setup only checks that an ABN is correctly formatted and not already registered elsewhere on the site - it is not a substitute for checking the Australian Business Register, a trade licence or ownership of the equipment. We may suspend or close accounts that break these terms or the listing rules.

Listings, services and safety claims

A listing should state the actual model, condition, known faults, what is included and a real asking price. Do not describe equipment, electrical work, refrigerant work or an installation as approved, certified or compliant unless you can currently back that up. Anyone advertising installation or service work carries responsibility for holding every registration, licence, permit, insurance policy and safety duty the work requires, including a current ARCtick licence for anything touching a refrigerant circuit. We may remove a listing or ask you to substantiate a claim.

Plans, boosts and payments to us

The Free Private tier allows up to five active ads at no cost. Private Seller Plus is A$14.95 a month including GST and raises that cap to 25 active ads, plus the private-seller tools listed on the plan. Business accounts are free and uncapped while the marketplace is in launch. A featured boost costs A$9.95 and runs for 30 days; there is no separate paid repost product. A paid benefit only begins once Stripe has confirmed the payment succeeded - if a Plus renewal fails, the extra ad capacity and tools pause until it is resolved, and a boost payment that fails never starts or extends the boost. None of this affects your refund rights under Australian Consumer Law.

Buyer and seller rights

How Australian Consumer Law applies depends on who is selling. A business must not mislead buyers and can owe consumer guarantees on top of anything stated in the listing. A private, one-off sale of a used compressor or split system does not usually carry those same guarantees, though the seller still needs to actually own the item, be able to hand over undisturbed possession of it, and not be selling it subject to an undisclosed debt. Nothing here removes a right that the law says cannot be removed.

Acceptable use

Do not list anything unlawful, stolen, counterfeit, recalled or otherwise prohibited; do not mislead other users; do not scrape or harvest personal details; do not interfere with how the service runs; and do not use messaging for anything other than a genuine enquiry about a listing. Optional marketing

You do not need to opt in to marketing to use the marketplace. When you list an item, you can separately choose to receive relevant marketing from Aircon & HVAC Marketplace and from the wider NearMe Ads network, by email, SMS or both. Messages about your account or an active transaction are never treated as marketing. Either consent can be withdrawn from Account preferences at any time, and a network-wide opt-out always overrides a channel-specific opt-in.

Your content

You keep ownership of the photos and text you post, and by posting them you license us to display that content to run and promote the marketplace. Only upload content you actually have the right to use.

Liability

Nothing in these terms excludes your rights under Australian Consumer Law. Outside of what applicable law requires us to guarantee, the platform is provided as is, and we are not liable for what a buyer or seller does, for the condition of an item, for an installation or service, for a message sent through the site, or for the outcome of any direct transaction between users.
